Company tax can present complications to taxpayers. This paper analyses some of the important issues, including treatment of resident and non-resident companies and also the rules that govern the claiming of losses carried forward and the writing off of bad debts as they relate to companies.

The paper discusses the Continuity of Ownership Test and the Continuity of Business Test and also considers the situation of how losses and bad debts are treated if a Discretionary Trust owns more than 50% of the shares in a company.
